These general terms and conditions of sale apply to all sales on the www.urbanbiker.com website.

General conditions of purchase

These conditions apply to the relationship between UrbanBiker S.L. and users, in the use of the online store www.urbanbiker.com for the purchase of products and services through this.

The acceptance of the conditions of purchase implies that the user has read, understands and understands what is set forth herein, being a person with sufficient capacity to contract assuming the obligations set forth herein. No handwritten signature of validation is necessary, being this understood by clicking on the button “Confirm my order”.

The purchase contract for a property purchased on www.urbanbiker.com consists solely of the general conditions of purchase in effect at the time of the order and the order form.

Product availability

Our product and price offers are valid as long as they are visible on the site, within the limits of available stock.

Product availability information is provided at the time you place your order, exceptionally errors or changes may occur. If the items are not available after placing your order or the time elapsed before receiving them is considered too long for the consumer, you may cancel your order free of charge and obtain a refund.

Urbanbiker.com reserves the right to cancel any order in whole or in part in the event that the products in question are not available for an extended period of time.

However, if the product(s) temporarily unavailable turns out to be permanently unavailable, we will be informed as soon as possible to offer an equivalent product which the customer will be free to accept or refuse.

Product conformity and warranty

The photographs, texts, graphics and data sheets are taken for the most part from documentation prepared by the manufacturer UrbanBiker, reproduced under his control and with his consent.

The manufacturers of all the products we offer guarantee compliance with the legislation and standards applicable in Spain.

The items provided by urbanbiker.com are new and are guaranteed against any defect at the time of delivery. The warranties of each product are those provided by its manufacturer. These warranties may be different for each product.

Validation of the transaction

As soon as your order is registered, a packing slip with the details of your order will be sent to you by e-mail. This delivery note will specify the exact amount invoiced and the delivery conditions of your order. This delivery note implies acceptance of your order by urbanbiker.com and validates the transaction.

In case you do not receive this delivery note, we invite you to check your Client Area to verify that your order has been processed.

In case of suspicion of fraud, urbanbiker.com reserves the right to ask the Buyer for proof of identity, to carry out the appropriate checks and/or to make the payment by bank transfer, subjecting the execution of the order to compliance with these conditions.

The prices

Prices on the urbanbiker.com website are quoted in Euros, all taxes included, excluding shipping and related charges.

Prices are subject to change during the year, it being understood that products will be invoiced and paid for at the prices in effect at the time the order is placed.

We certify that the credit card details are encrypted using the SSL (Secure Socket Layer) protocol, and never pass unencrypted through the network or on the servers of urbanbiker.com. The payment is made directly to the bank and your bank details will never pass through our servers.

Delivery mode

The products will be delivered to the address you have indicated in the order form.

Different delivery methods are available before confirming the order. The contribution to the shipping costs associated with each delivery method is also detailed and indicated before validating the order. It is no longer possible to change the delivery method after validation and payment of the order.

Delivery from Monday to Friday, normally from 8:30 am to 6:30 pm depending on the conditions stipulated by the contracted transport agency. Delivery can be made throughout the day and it is not possible to specify the time of day.

In the event of a delay in delivery within eight working days of the shipment date indicated in the email informing you of the shipment of your order, we suggest that you contact our Customer Service by sending an email.

If the goods are found, they will be redirected as soon as possible to the address of the order. Otherwise, and once the loss report declared by the carrier has been obtained, we will reship this (these) product(s) or, in case of definitive unavailability, we will refund the sums charged in accordance with the terms of these general conditions of purchase.

We recommend that the buyer refuses any damaged, opened or soiled package. He may, if he wishes, before signing the receipt form, check the contents in the presence of the delivery person.

In case of doubt, it is advisable to refuse the package and report the incident to urbanbiker.com as soon as possible.

Warranties

Manufacturer’s warranties

Products purchased on our site benefit from the manufacturer’s warranty, indicated on each product sheet. The warranties of the different manufacturers may vary. The warranty takes effect on the date of receipt of the package during the period mentioned on the product sheet.

To benefit from the product warranty, you must keep the purchase invoice and all packaging.

Withdrawal

The customer has 30 days to retract from the day he/she receives the item. The customer is responsible for the shipping and delivery of the product by the transportation agency he/she deems most convenient, including shipping costs.

In addition:

• The item may not be used for any purpose other than an event(maximum 10 km in the case of a bicycle). A photograph of the total kilometers will be required.
• It must be shipped in the original packaging (protected as shipped) without any damage.
• It is mandatory to return the complete product, including instructions, tools, wrenches, accessories, etc…

No refund transaction will be made prior to receipt and review of the returned merchandise. Refunds will be made using the same method of payment you used for the original transaction, unless expressly agreed otherwise.

The customer will be responsible for the depreciation of the vehicle resulting from manipulations other than those necessary to establish the correct functioning of the item.

Any returns that do not meet these criteria will be subject to a partial refund of the item depending on the nature of the depreciation.

Proof of transaction

Unless proven otherwise, our computer records, maintained under reasonable security conditions, will provide evidence of communications, orders and payments made.

We will file purchase orders and invoices on a reliable and durable medium that can be legally presented as evidence.

Applicable Law

All clauses contained in these general conditions of sale, as well as all transactions referred to therein and any dispute that may arise in connection with an order or its consequences, are subject to Spanish law.

If one or more of the provisions of these general terms and conditions are declared null and void or are declared void by virtue of a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.
